Is Selling Data Legal? What Companies Must Check First

Is selling data legal? It depends on what the records contain and what you agreed to, so check the areas below before you sign anything. Generally yes, if you own it, your contracts allow it and personal information is removed. Here's how to check each one.

The short answer

In most cases, yes. A company can license operational data it owns under a proper agreement. Three questions decide most cases: do you own the data, do your contracts allow it, and is personal information removed to a documented standard before it moves. Get an attorney to review the license before you sign.

1. Do you own it? Whether selling data is legal starts with ownership

Records about your own operations, like internal chat, your sales pipeline and your support conversations, are generally yours. Data you hold on behalf of clients usually isn't. An agency's client files, a law firm's case documents or a payroll provider's client payroll records belong to someone else. Good buyers exclude client-owned data from the license.

2. Do your contracts allow it?

  • Customer agreements. Confidentiality clauses and data use limits can restrict what you license.
  • Vendor terms. Some software terms limit how exported data can be used.
  • Privacy policy. What you told customers about how their information would be used.
  • Investor rights. Some financing documents require approval for sales of major assets.
  • Employee agreements and handbooks. What you told staff about workplace communications.

3. Is personal information removed?

Names, emails, phone numbers and account numbers should be stripped before the data moves to AI developers. Under the GDPR, truly anonymous data falls outside the regulation, but pseudonymized data that can be linked back to a person is still personal data. See how anonymization works.

Regulated data needs extra care

Health records, financial account data, data about children and anything covered by sector rules have their own requirements. Most buyers exclude this data or handle it under specific safeguards.

The privacy concern is real

Privacy advocates point out that workplace messages are written by identifiable people who never expected them to be sold, and that even anonymized messages can carry identifying details. Read selling employee messages before you decide.

In bankruptcy

Selling personal information in a bankruptcy can trigger a court-appointed consumer privacy ombudsman. See company data in bankruptcy.

Common questions

Is it legal to sell company data to AI companies?

Generally yes, when you own the data, your contracts allow it, and personal information is removed before transfer.

Can I sell customer data?

Selling identifiable customer data is restricted by privacy laws and your own privacy policy. AI data deals remove identifying details, and client-owned data is excluded.

Do I need employee consent?

It depends on where you operate and what your policies said. Ask your attorney. Anonymization before transfer is standard either way.

Do I need a lawyer?

Yes. Have an attorney review the license, your customer contracts and your privacy policy before you sign.
